Warranty & Statutory Guarantee

Two-Year Statutory Guarantee (Gewährleistung)

Consumers have a statutory guarantee of two years from delivery for defects existing at the time risk passed, in accordance with §437 and §438 BGB implementing EU Directive 2019/771. These rights are non-waivable and cannot be excluded or limited to your disadvantage for new goods.

During the first 12 months after delivery, a defect that becomes apparent is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or the defect (reversal of burden of proof, §477 BGB). After this period, you may need to demonstrate that the defect existed at delivery.

Remedy Hierarchy

In the event of a defect you are first entitled to supplementary performance (Nacherfüllung) under §439 BGB, namely repair or replacement, at your choice, unless the chosen remedy is impossible or disproportionate.

Only if supplementary performance fails, is refused, or is unreasonable may you, in a second step, reduce the purchase price or withdraw from the contract (§437 No. 2 and 3 BGB). Claims for damages or reimbursement of wasted expenditure remain possible under the statutory conditions. A minor defect does not entitle you to withdraw.

Statutory Guarantee vs. Commercial Guarantee

The statutory guarantee (Gewährleistung) is your mandatory legal right against us as the seller and always applies free of charge.

A commercial guarantee (Garantie, §443 BGB) is a voluntary, additional promise that a manufacturer or seller may give beyond the statutory guarantee. Where a manufacturer or we provide such a guarantee, its specific terms, duration and scope are stated with the product or in the guarantee statement supplied with the goods. A commercial guarantee never restricts or replaces your statutory guarantee rights.

We will advise on the return or inspection of the goods. Necessary expenses for supplementary performance, such as transport, are borne by us.
